Welcome to FirstMark Data, operated by GROWQUIKR ONLINE SERVICES LLP ("FirstMark Data," "we," "us," or "our"), a limited liability partnership registered in Assam, India. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and GROWQUIKR ONLINE SERVICES LLP, governing your access to and use of the FirstMark Data website at https://firstmarkdata.com and application at https://app.firstmarkdata.com, and all related tools and services (collectively, the "Service").
FirstMark Data is a new business intelligence platform that processes publicly available public domain registration records to surface newly registered business contacts, enabling B2B service providers to identify and reach new businesses at the moment of launch.
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and our Acceptable Use Policy (collectively, the "Agreements"). If you do not agree, you must not access or use the Service.
To use the Service, you must: (a) be at least eighteen (18) years of age; (b) have the legal capacity to enter into a binding agreement; (c) not be barred from using the Service under the laws of your jurisdiction; and (d) not have been previously suspended or removed from the Service. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
To access the Service, you must create an account by providing accurate, current, and complete information. You agree to maintain and promptly update your account information at all times.
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify FirstMark Data of any unauthorized use of your account at legal@firstmarkdata.com. FirstMark Data shall not be liable for any loss arising from your failure to maintain account security.
Each user may maintain only one (1) active account. Account sharing, transferring, or selling your account to any third party is strictly prohibited. Violation may result in immediate account termination.
All business contact data surfaced by FirstMark Data originates from public public domain registration records. Domain registrants are explicitly presented with the choice to make their contact information public or private at the time of registration through their domain registrar. FirstMark Data only processes contact information from registrants who chose public disclosure. Privacy-protected registrations - where registrants opted for domain registration privacy protection services - are filtered at the data ingestion stage and never surface on the platform. By choosing public domain registration, registrants made an informed, active decision to publish their contact information on a globally accessible public database administered by ICANN.
FirstMark Data is a credit-based new business intelligence platform that processes publicly available public domain registration records to surface newly launched business contacts. The Service provides:
All business contact data is sourced exclusively from publicly available public domain registration records. FirstMark Data does not access private, password-protected, or restricted databases. Privacy-protected domain registration records are filtered at ingestion and never surface on the platform. All data is automatically purged after thirty (30) days from the date of registration.
The Service operates on a credit-based system. Credits are consumed as follows:
FirstMark Data operates on a non-recurring, purchase-based model. There are no automatic recurring charges. Each plan purchase is a one-time transaction. You must manually renew your plan each month if you wish to continue paid access. We are not responsible for service interruption if you do not renew.
Credits are valid for the calendar month of purchase. Unused credits expire at the end of the month and do not roll over. Credits are non-transferable between accounts and cannot be exchanged for cash.
Founder pricing is offered to the first 150 users at a 40% discount, locked for the lifetime of the account. Founder pricing is personal to the account holder and cannot be transferred. FirstMark Data reserves the right to close founder pricing at any time once the 150-user limit is reached.
FirstMark Data reserves the right to modify plan pricing at any time. We will provide at least thirty (30) days' prior notice of pricing changes via email. Founder pricing is exempt from general price increases.
All fees are exclusive of applicable taxes, including GST. You are responsible for paying all applicable taxes associated with your purchases.
All purchases are final and non-refundable. Please refer to our full Refund Policy for details on exceptions including duplicate charges, extended outages, and unauthorized transactions.
The Service, including its software, algorithms, user interface, design, graphics, logos, and all related intellectual property, are and shall remain the exclusive property of GROWQUIKR ONLINE SERVICES LLP. These Terms do not grant you any right or interest in our intellectual property except for the limited license expressly granted herein.
Subject to your compliance with these Terms, FirstMark Data grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes, including sales prospecting, market research, and business development. This license does not permit you to reproduce, distribute, reverse engineer, or create derivative works based on the Service.
By using the Service, you acknowledge and agree that:
FirstMark Data employs automated monitoring to detect platform misuse. Accounts exhibiting misuse patterns may be suspended or terminated.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GROWQUIKR ONLINE SERVICES LLP, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL FIRSTMARK DATA'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO FIRSTMARK DATA IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR (B) ONE THOUSAND INDIAN RUPEES (INR 1,000).
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. FIRSTMARK DATA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FIRSTMARK DATA DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY BUSINESS CONTACT DATA RETRIEVED THROUGH THE SERVICE.
You agree to indemnify, defend, and hold harmless GROWQUIKR ONLINE SERVICES LLP and its affiliates, officers, directors, and employees from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your use of business contact data obtained through the Service.
FirstMark Data may terminate or suspend your account immediately, without prior notice, at its sole discretion, for any reason including breach of these Terms, violation of the Acceptable Use Policy, suspected fraudulent activity, or non-payment. Upon termination, your right to use the Service will immediately cease. Unused credits at the time of termination for cause are forfeited and non-refundable.
These Terms shall be governed by and construed in accordance with the laws of Assam, India, without regard to conflict of law provisions.
Before filing any formal legal claim, you agree to first attempt to resolve any dispute informally by contacting us at legal@firstmarkdata.com. The parties agree to negotiate in good faith for at least thirty (30) days before initiating formal proceedings.
Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Assam, India.
These Terms, together with the Privacy Policy, Refund Policy, and Acceptable Use Policy, constitute the entire agreement between you and FirstMark Data concerning the Service.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
FirstMark Data shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, power failures, or third-party service outages.
